Supreme Court Rules Against Toll Charges on AP-9 During Construction in Galicia
The Supreme Court has ruled that tolls cannot be charged on highways undergoing construction. This decision supports the claims of drivers affected by roadworks on the AP-9 highway in Galicia, who demanded refunds due to severe traffic disruptions.
The court's ruling upholds an earlier trial court decision, which had been overturned by the Pontevedra Provincial Court. As a result, Autopistas del Atlántico, the company managing the AP-9, must now reimburse the users for tolls paid during the construction period.
This verdict sets a clear precedent: tolls should not be collected when road conditions significantly deteriorate due to maintenance or upgrades, reflecting growing concerns from commuters about paying for disrupted service.
For expats and locals alike, this means financial relief and recognition of the inconvenience caused by long-running works on one of Galicia's main highways.
